What is a restitution hearing?

A restitution hearing is a court proceeding that determines the amount of money or property that a defendant must pay to a victim to compensate for the harm or damage caused by their criminal activity. The hearing is typically held after the defendant has been found guilty or has entered a guilty plea, and it may be conducted as a separate proceeding or as part of the sentencing process.

At the hearing, the victim or their representative may present evidence and testimony to support their claim for restitution. This may include medical bills, lost wages, and other expenses incurred as a result of the defendant's actions. The defendant may also have the opportunity to present evidence and argue against the amount of restitution requested.

Once the hearing is complete, the judge will make a determination regarding the amount of restitution to be paid and may order the defendant to make payments directly to the victim or to a government agency that will distribute the funds. Failure to pay restitution as ordered may result in additional legal consequences, including fines or imprisonment.
